1.1. This document is a public offer (hereinafter — the "Agreement") and defines the terms of using the ARES website and purchasing the products offered on it, in accordance with Articles 633 and 641 of the Civil Code of Ukraine and the Law of Ukraine "On Electronic Commerce".
1.2. By placing an order on the website, you confirm that you have read and fully accept the terms of this Agreement. The Agreement is considered concluded from the moment the Seller confirms the order (verbally, in writing, or by electronic message).
2.1. The Seller undertakes to transfer ownership of evacuation equipment (drag stretchers and related products) to the Buyer, and the Buyer undertakes to accept and pay for the goods under the terms of this Agreement.
2.2. All product listings on the website constitute a public offer in accordance with applicable Ukrainian legislation.
3.1. Orders are placed via the website form, by phone, or through the messengers listed in the Contact section.
3.2. The Buyer undertakes to provide accurate contact details when placing an order.
3.3. Payment is made by bank transfer to the Seller's account or online by bank card via the WayForPay payment service. All payments are made in Ukrainian hryvnia (UAH). Bank card data is processed directly by WayForPay in accordance with the PCI DSS security standard and is not stored on the ARES website.
4.1. Delivery is carried out by courier services throughout Ukraine, as well as internationally by separate arrangement.
4.2. Delivery timeframes and cost are agreed with the Buyer individually when the order is confirmed.
4.3. The Buyer is required to inspect the goods upon receipt and verify that they match the order.
5.1. The Company accepts returns and exchanges of goods of proper quality in accordance with the Law of Ukraine "On Consumer Rights Protection".
Return and exchange period. Goods may be returned or exchanged within 14 days of receipt by the Buyer. Return shipping is arranged by agreement between the parties.
Conditions for returning goods of proper quality:
— The goods may be returned if they have not been used and retain their commercial appearance and packaging.
— Goods may be returned via Nova Poshta; the cost will be refunded to your bank card once the parcel is received.
— Cash-on-delivery returns are not accepted.
5.2. In accordance with the Law of Ukraine "On Consumer Rights Protection", the Company may refuse to exchange or accept the return of goods of proper quality if they fall under the categories listed in the current List of Non-Food Goods of Proper Quality Not Subject to Return or Exchange.
6.1. The Seller undertakes to provide accurate product information, fulfill the order within the agreed timeframe, and maintain the confidentiality of the Buyer's data.
6.2. The Buyer undertakes to pay for the order in a timely manner, provide accurate contact information, and comply with the terms of this Agreement.
7.1. The parties are liable for failure to fulfill or improper fulfillment of the terms of this Agreement in accordance with applicable Ukrainian law.
7.2. The Seller is not liable for delays or inability to fulfill an order due to circumstances beyond the Seller's control (force majeure, carrier disruptions, technical failures, etc.).
8.1. The Seller guarantees the protection of the Buyer's personal data in accordance with applicable Ukrainian law and the website's Privacy Policy.
9.1. Any disputes are resolved through negotiation, and failing agreement, in the manner prescribed by Ukrainian law.
9.2. The Seller reserves the right to amend this Agreement. Changes do not apply to orders confirmed before the updated version is published. The updated version takes effect from the moment it is published on the website.
